terms & conditions

The venue setup, event, and breakdown time should be included in your rental. 

All event rentals include access to:

  • Prep Area (Fridge/ Microwave/ Commercial Sink)

  • 80 chairs

  • 9 Round Tables

  • 6 Rectangle 6ft Tables

  • 5 Cocktail Tables 

  • 20 Barstools

  • Mobile Bar

  • Uplighting

  • Full Servingware (80 Wine Glasses, 80 Plates, 80 Cutlery Sets)

  • 2 Single Occupancy Restrooms

  • 1800 sq ft space that can accommodate up to 120 guests standing 80 guests seated 

  • Cleaning of Venue ( Included)  - Checklist for cleaning is provided and host must prep space for cleaning.

  • Outdoor Bistro Seating


The “Venue” is Smith Ave. Event Studio , and is located at 3695 Kirby Drive, Ste 105 Pearland, Texas 77584 . “Renter” is the person or entity renting the Venue for private or public use.

“Renter’s Associates” are guests, invitees, contractors, and all other persons whatsoever enter the Venue during the rental period, whether or not such persons did so with the Renter’s knowledge or consent. 



Renter must be 21 years of age or older in order to book an event at Smith Ave. Event Studio. Renter must present a valid state ID, Driver’s license, or passport at the time of booking. It is collected during the booking process. . A copy of Renter’s identification will be kept on file for verification purposes only. Minors must be accompanied by a parent or legal guardian at all times. Smith Ave Event Studio has a total Venue occupancy of 120. Renter is responsible for ensuring that there are no more than 120 occupants within the Venue at any given time.



Renter may only occupy Smith Ave. Event Studio during the timeframe specified in the booking agreement. Renter is required to complete set-up and tear-down within this defined timeframe. All outside deliveries/pickups must be made within this defined timeframe. If tear-down and removal of non-Smith Ave. Event Studio equipment is not completed by the end of the rental time, Renter will be responsible for additional rental time at the overtime rate listed in the accompanying booking form.



At the time of booking, Renter is required to place a credit card on file to pay a deposit of 50% of the total rental cost. The 50% deposit is NON-REFUNDABLE.  The remaining balance is due 30 days prior to the rental date. Event Studio has the right to cancel a rental for non-payment. Any full payments/promo specials are non refundable. All fees paid to Smith Avenue is nonrefundable. If you event is cancelled, a studio credit will be issued. See cancellations.



A Security Deposit in the amount of $200 is required and a credit card to hold such deposit must be provided to Smith Ave. Event Studio at least two days prior to the rental date. The Security Deposit will be held via Square and Renter’s credit card will not be charged (but will be seen as “pending”) during the rental period. Unless Smith Ave. Event Studio deems it necessary, in order to repair any damage inflicted upon the Venue by Renter and/or Renter’s Associates, the Security Deposit will be released to Renter following the expiration of the rental period. If damages and/or infractions exceed the reserved $200 amount, Smith Ave. Event Studio can charge up to an additional $800 to cover damages.


Smith Ave. Event Studio will process the Security Deposit transaction as quickly as possible. However, this process may take up to 7 business days following expiration of the rental period to be completed.



Renter will not receive any portion of the non-refundable deposit in the event that a rental is canceled or postponed. A cancellation/transfer fee of $150 will be charged at the time of cancellation/transfer.


If a rental is canceled at least 30 days prior to the rental date, Renter may apply the 50% deposit toward a future rental date (transfer); payments made in excess of the 50% deposit can applied toward a future rental date. The transfer date must be within 12 calendar months of the original rental date. Only one transfer is allowed per rental. NO REFUNDS ON ANY PAYMENTS MADE. 


If a rental is canceled less than 30 days prior to the rental date, all payments made are nonrefundable, and the balance of the rental price will be charged to Renter’s credit card on file. Smith Ave. Event Studio reserves the right to take all legal steps to collect any balances that are unpaid and owed by Renter to Smith Ave. Event Studio. Smith Ave. Event Studio will not provide refunds for situations beyond the control of Smith Ave. Event Studio. , including, but not limited to, delays due to road construction/closures, weather, death, uncontrollable circumstances etc. 



Smith Ave. Event Studio demands strict adherence to state laws regarding alcohol consumption at the Venue. Smith Ave. Event Studio’s Alcohol Policy will be posted at the front entrance of the Venue. If Renter elects to offer alcohol during the rental period, Renter must understand and adhere to the following:

* Smith Ave. Event Studio requires that all attendees of events in which alcohol is to be served must be at least 21 years of age.

* Smith Ave. Event Studio prohibits the sale of alcohol on the premises without a permit. If alcohol is sold during a rental period, Renter must: (1) obtain permission from Smith Ave. Event Studio; and (2) obtain a temporary TABC permit that must be signed by Smith Ave. Event Studio. NOTE: obtaining a temporary permit can be costly and takes time (usually 45-60 days, but sometimes longer).

* Renter may sell tickets for entrance into Renter’s event, but the tickets cannot be used to obtain alcoholic beverages at the event. Renter is prohibited from posting anything online or in print regarding the sale of alcohol at Renter’s event. If alcohol is mentioned, it must state that it is either free or BYOB (i.e. “bring your own beverage”).

As a temporary lessee of the Venue, Renter is permitted by law to provide free alcoholic beverages without a permit. However, to be truly “free” any alcohol that is served must be available to any individual over the age of 21. If free alcoholic beverages are only available to paying customers, the law assumes that the cost of the alcohol is included in the price of the service. In this case, the Renter would be “selling” the alcoholic beverages, and a permit would be required. In other words, when a Renter provides “free” alcoholic beverages, there cannot be any expectation of receiving money. The Renter cannot ask for a “donation” or “tip.”

* Any and all liabilities arising from the consumption of alcoholic beverages on Smith Ave. Event Studio premises are the responsibility of the Renter. All Texas state laws and Federal Laws must be adhered to at all times.

* Renter may not serve alcohol to minors on Smith Ave. Event Studio premises at any time. In addition, Renter must, for everyone’s safety, ensure that alcoholic beverages are consumed in a responsible manner. Smith Ave. Event Studio reserves the right, in its exclusive discretion, to expel anyone from the premises who, in its judgment, is intoxicated or under the influence of alcohol or drugs, or who otherwise engages in behavior that jeopardizes the rights of Smith Ave. Event Studio or the safety of its patrons, staff, guests, employees or property.

* Law enforcement must be present at all rentals in which alcohol is being served. Renter must secure law enforcement directly through Smith Ave. Event Studio. Securing law enforcement officials outside of the direct contacts of Smith Ave. Event Studio is prohibited.


Smith Ave. Event Studio encourages Renter/Renter vendors and Renter guests to take photos during the rental. Smith Ave. Event Studio hopes that Renter will share these pictures. Any pictures shared with Smith Ave. Event Studio can be used for promotional purposes. By reserving your space, you authorize and give permission for Smith Avenue Studio to take photos/ videos of space for promotional material and social publications. 



Smith Ave. Event Studio wants to make every rental a special and welcome experience. Therefore, every effort will be made to allow Renter to prepare decorations reflecting their creative requirements but rules must be followed as listed in rental agreement. 



Smith Ave. Event Studio will be in a clean and good condition prior to Renter’s event. Renter is required to prep the Venue to the same clean condition it was in when Renter took possession. Our event technician handles the heavy cleaning, however, all Renters are required to complete a Pre Cleaning Checklist. The following is the responsibility of the Renter: 

  1.  All trash must be removed from tables/ chairs and floors and placed in trash collection sites around the studio. At the end of the event all trash must be bagged and placed in dumpster ( Next to Kirby Smiles) Trash cannot be dragged on concrete or deposit will be charged. Please ensure bags are not leaking. 

  2. All furniture/equipment/decorations brought into the Venue by Renter or Renter’s Associates must be removed from the premises prior to the expiration of the rental period. Failure to return the Venue to the same clean and good condition it was in when Renter took possession will result in the loss of all or part of Renter’s Security Deposit. Similarly, any damage inflicted upon the Venue by Renter and/or Renter’s Associates may also result in the loss of all or part of the Security Deposit.

  3.  Ensure no gum or gunk is stuck to the underside of the countertops, tables, or in the sink.

  4. Wash, dry and put away dishes and any prep items from kitchen area. 

  5. Remove everything from the refrigerators and microwaves. No items should be left behind.

  6. Pickup all trash and debris from outside space. 

  7. Turn off lights and ensure all doors are locked 

  8. Send text to 832.736.0639 when you have vacated space. 


Please help us keep Smith Ave. beautiful. If during your event, you notice any of the following, please ask the event tech for assistance: 

  1. Cleanup any and all liquid spills immediately 

  2. Clean up any broken glass 


 In the event that any glass is broken during your event, you must report the breakage to us no later than the end of your event. This ensures that our cleaning crew is able to do a follow-up clean of the area after your event.

* Notify us immediately of any damage done to the venue.

* Notify us of any broken tables and chairs just that we are aware of replacing.

Smith Ave. Event Studio will provide all necessary cleaning supplies to be used for cleanup. Cleaning supplies not provided by Smith Ave. Event Studio are not allowed to be used to clean up the venue. Cleaning supplies can be found under the sink in the prep area. Brooms/dustpans and mops are supplied and can be found in the kitchen prep room.


Smith Ave. Event Studio is a non-smoking facility. Smoking is not permitted inside the Venue or within 30ft of any entrance/exit to or from the Venue. Renter and all of Renter’s Associates are prohibited from all forms of smoking, which includes, but is not limited to, smoking cigarettes, cigars, marijuana, CBD products, hookah, illicit drugs, etc. Violation of this policy will result in the loss of the full amount of Renter’s Security Deposit.



Smith Ave. Event Studio is equipped with video monitoring equipment to ensure the safety of both the Venue and Renter. Recordings are reviewed only in the event of an incident or when deemed necessary by the Venue for security purposes. Recordings are never released publicly or sold and will remain in the sole possession of Party Smith Ave. Event Studio unless disclosure is otherwise required by law.


Renter agrees to comply with all applicable city, county, state, and federal laws and shall not engage in any illegal activity on Smith Ave. Event Studio premises. Smith Ave. Event Studio is a drug-free and non-smoking facility at all times, NO EXCEPTIONS.



Renter and Renter’s Associates are, at all times, prohibited from loitering or congregating outside of the Venue, which includes the parking lot bordering the Venue and all immediately surrounding areas.

Disparaging remarks or any type of physical violence by Renter or any of Renter’s Associates will not be tolerated and will be cause for immediate expulsion from the Venue. Renter and Renter’s Associates must use the premises in a considerate manner at all times. Conduct that Smith Ave. Event Studio, in its sole discretion, deems disorderly may be grounds for immediate expulsion from the premises and immediate termination of the rental period. In such cases no refund of the rental fee will be made.



Special Event Liability Insurance is highly recommended, but not required from Renter. If Renter chooses to provide insurance, proof of such insurance must be provided to Smith Ave. Event Studio at least ten (14) days prior to the rental date. The insurance must, at Renter’s sole expense, provide and maintain public liability and personal property damage insurance, insuring Smith Ave. Event Studio, contractors and contracted vendors, and all other occupants on the premises during the rental period, against all bodily injury, property damage, personal injury and other loss arising out of Renter’s use and occupancy of the premises, which includes all appurtenances to the premises. The insurance required hereunder shall have a single limit liability of no less that $1 Million, and general aggregate liability of not less than $2 Million. Smith Ave. Event Studio shall be named as an additional insured of said policy.

Any caterers and/or outside vendors, companies, and/or institutions who will be present at the Venue during the rental period MUST provide a copy of their Certificate and Catering License to Smith Ave. Event Studio at least ten (14) days prior to the rental date.

  • Are we allowed to bring in our own food?
    Yes- outside food is allowed.
  • Do we have to clean the venue after use?
    A professional cleaning services cleans after each event. We have a checklist onsite that must be followed to prepare space for cleaning.
  • Can we bring alcohol?
    Please see Terms and Conditions regarding alcohol on premises. Short answer is yes.
  • Is there a deposit required?
    An initial deposit of 50% is due at the time of booking
  • What’s included in the rental?
    Full venue space, restrooms, and prep space. Please visit website to view full list of amenities available with rental.
  • What is the maximum capacity of the event studio?
    Our studio comfortably accommodates up to 120 guests, making it ideal for small, intimate gatherings.
  • What types of events can be hosted at the studio?
    We welcome a variety of events including weddings, corporate meetings, private parties, workshops, and art exhibitions.
  • Are there catering services available?
    Yes, While we do offer in-house catering, we have a list of preferred caterers and are happy to work with any licensed caterer of your choice.
  • Do you have audio/visual equipment?
    We offer a speaker and Bluetooth Audio equipment to meet your event needs.
  • Is there a parking facility nearby?
    Yes, there is ample parking available near the studio for your convenience.
  • Can the studio layout be customized?
    Absolutely! We offer flexible layout options to suit the specific needs of your event.
  • Are there any accommodation options nearby for out-of-town guests?
    Yes, there are several hotels and guesthouses in the vicinity that we can recommend. ( Pearland Town Center)
  • What is the booking and cancellation policy?
    We require a 50% deposit to secure your booking, the balance is due 30 days prior to the event. Our cancellation policy is outlined in our booking form.
  • Do you offer event planning services?
    We have an in-house event planning team available to help coordinate your event details.
  • Is the venue accessible for guests with disabilities?
    Yes, our studio is fully accessible to ensure comfort and safety for all guests.
